Foggia – Former Oddone Barracks: the Regional Administrative Court grants the residents’ application for single-judge interim measures

The Regional Administrative Court of Puglia, Bari, by a presidential decree of 8 April 2021, suspended the effect of the latest order of the Mayor of the Municipality of Foggia requiring the residents to vacate the building of the former Oddone Barracks, at via Tenente Colonnello Attilio Muscio no. 2. This is until 11 May next, the date of the chamber hearing to discuss the interim application made in the action. Some of the residents of the building instructed Studio Legale LTC of Bari and, with the representation of Attorney Alessandra Casamassima, challenged yet another measure by which the Municipality of Foggia ordered the premises to be vacated, without ensuring decent rehousing for residents who have been waiting for years for a “new” placement. The Regional Administrative Court held that the conditions of extreme gravity and urgency were met, such that the matter could not be deferred until the useful chamber date, fixed for 11 May 2021. Until that date, therefore, the residents may remain in their homes. We hope, in any event, that the administrations concerned will shortly find a solution which protects both the rights of the residents of the building, most of whom were placed there by the Municipality of Foggia itself to meet the housing emergency arising from the clearance of the former Scivar block where they had been living, and the preservation and use of a building, the former Oddone Barracks, of particular cultural interest.
