If a business is subject to insolvency proceedings, that is bankruptcy, a composition with creditors, compulsory administrative liquidation or extraordinary administration, the INPS Guarantee Fund may take the place of the employer who has not performed his duties towards the worker for payment of the TFR and of the last three months' wages.
The worker may recover through the Guarantee Fund the sum due by way of TFR and the last three months' wages.
The INPS Guarantee Fund pays on condition that the claim is established in an enforceable title, which will be followed by a payment order, attachment, a declaration of bankruptcy and admission of the bankruptcy claim in the statement of liabilities of the proceedings. The application must therefore be submitted to the INPS office in whose territorial competence the worker resides.
